Activities Carried Out 4.1. In France, MyLocTravel (SAS) is a duly authorized real estate agency holding its own professional license. The company operates independently in the following activities: Real estate transactions (buying/selling), Rental management (rent collection, lease drafting), Concierge services and seasonal rentals (reception, cleaning, operational management). These activities are carried out primarily under its commercial and local brands Valras'Loc and Agde'Loc. 4.2. In the United States, MyLocTravel, Inc. manages and operates real estate located in the United States in accordance with applicable U.S. laws and regulations, including: Obtaining the local licenses and permits required by each municipality to operate short-term rentals; Collecting and remitting the Short-Term Rental Lodging Tax at the rate of 4.5% in Delaware, as well as applicable local taxes in each state of operation; Adhering to fire safety standards, including fire extinguishers, smoke detectors, escape routes, and regular inspections by the appropriate authorities; and Complying with the building and public health codes of each state. 5. Specific Regulatory Obligations in the United States 5.1. Registration and Licenses MyLocTravel, Inc., incorporated in Delaware, must complete "Foreign Qualification" (registration as a foreign entity) in each U.S. state where it operates real estate. This obligation entails: Obtaining a Certificate of Authority before being able to obtain local business licenses; Appointing a Registered Agent in each state of operation; Filing annual reports and paying taxes in each state. 5.2. Taxes and Fiscality Transit Occupancy Tax (TOT): Approximately 30 U.S. states impose transit occupancy taxes at the state level, and many states also allow cities and counties to add supplementary taxes. These taxes apply to short-term rentals through services such as Airbnb, HomeAway, or VRBO. Rates vary by jurisdiction: Delaware: 4.5% (state short-term rental tax); California: varies by city (14% in Los Angeles, 10.50% in San Diego); Florida: state sales tax plus local tourism development taxes. In most cases, the operator is responsible for collecting taxes from guests and remitting them to the appropriate authorities. 5.3. Commercial General Liability Insurance: Many cities have adopted ordinances regarding short-term rentals requiring commercial general liability insurance to obtain a permit. Recommended requirements: Commercial General Liability Insurance with a minimum coverage of $1 million, and $2 million if possible. A commercial policy covering buildings, contents, commercial liability, and loss of income, also including personal liability when the short-term rental serves as the owner's primary residence. 5.4. Safety and Compliance Standards: Rentals must comply with state fire safety laws, including having working fire extinguishers, smoke detectors, escape routes, and adhering to the fire code. Regular inspections by the fire marshal are required. Additional requirements apply to units with pools or spas. 6. Personal Data (GDPR & Data Protection) 6.1. For properties in France (GDPR): The data collected (forms, reservations) is processed exclusively by MyLocTravel strictly within the framework of carrying out its real estate and commercial missions. Purposes: Reservation management, invoicing, customer relations, execution of transaction/management mandates, legal obligations. Rights: You have the right to access, rectify, object to, and erase your data. GDPR contact: contact@myloctravel.com or by mail to the head office. 6.2. For properties in the United States: The personal data of clients booking properties located in the United States may be processed and stored in accordance with applicable US data protection laws. MyLocTravel, Inc. is committed to protecting the confidentiality and security of your personal information. 7. Cookies: The site uses technical cookies (necessary for operation) and audience measurement cookies (Google Analytics, Facebook Pixel). You can configure your preferences via the cookie banner when you arrive on the site. 8. Intellectual Property All elements (texts, MyLocTravel, Valras'Loc, Agde'Loc logos, photos) are the exclusive property of MyLocTravel, MyLocTravel, Inc. or their respective authors. For properties located in the United States: Disputes relating to properties located in the United States will be handled in accordance with the dispute resolution procedures applicable in the state concerned. Clients may also contact the consumer protection agencies in the state where the rented property is located. 10. General Booking Conditions The complete General Terms and Conditions are available on the booking engine. 10.1. Scope These conditions apply to bookings made on the MyLocTravel websites (and under its brands Valras'Loc and Agde'Loc). They bind the Traveler (Renter) and: MyLocTravel (SAS) for properties located in France MyLocTravel, Inc. for properties located in the United States Both entities act as agents for the Owners. 10.2. Payment and Booking Deposit: 30% upon booking Balance: 70% charged 60 days before arrival (or immediately for late bookings) Payments are secured via the platform's payment gateway (Stripe/Guesty Pay). For properties in the United States: Amounts may be displayed in USD ($) and are subject to applicable local taxes (Transient Occupancy Tax, Sales Tax, etc.). 10.3. Security Deposit (Caution) A security deposit is required for each stay (amount varies depending on the property). It is generally managed as a credit card imprint (pre-authorization) which is not charged, except in the case of proven damage. 10.4. Cancellation and Withdrawal For properties in France: Right of withdrawal: In accordance with Article L221-28 of the French Consumer Code, the 14-day right of withdrawal does not apply to contracts for accommodation services provided on a specific date. Cancellation policy: The conditions (Refundable/Non-refundable) are those chosen by the customer at the time of booking and indicated on their confirmation. For properties in the United States: The cancellation conditions are those chosen at the time of booking. If cancellation insurance covering the risk of mandatory evacuation and costing no more than 8% of the rental price was offered before the start of the stay, and the customer did not purchase it, the owner is not obligated to provide a refund in the event of a mandatory evacuation. After the lifting of the mandatory evacuation order, the owner must provide a refund if the property cannot be provided in a habitable condition or if a reasonably comparable property cannot be offered. 10.5. Responsibility: The tenant agrees to use the premises peacefully and to comply with the house rules. In the event of a technical or medical emergency, MyLocTravel or MyLocTravel, Inc. does not replace emergency services but remains the primary contact for managing the property. For properties in the United States: Once someone agrees to pay for a service such as renting your property, you assume a greater responsibility to identify and minimize risks. "Negligence" can put you in a position where a client and their lawyer may see an opportunity to prove that an injury resulted from your lack of attention to safety details. The operator must maintain high safety standards and have adequate commercial liability insurance. 10.6. Governing Law and Jurisdiction: For properties located in France: These terms and conditions are governed by French law. In the event of a dispute that cannot be resolved amicably, the competent courts are those within the jurisdiction of the Court of Appeal of Montpellier (Tribunal de Béziers), subject to the mandatory provisions applicable to consumers. For any dispute relating to the performance of the mandate, if you are a "consumer" within the meaning of the preliminary article of the French Consumer Code, you may contact our consumer mediator (see section 9.1). For properties located in the United States: Reservations for properties located in the United States are governed by the laws of the State of Delaware and applicable U.S. federal laws, as well as the local laws of the state where the rented property is located. In the event of a dispute, the parties will endeavor to resolve the dispute amicably. Failing this, jurisdiction will be conferred upon the competent courts of the state in which the property is located, in accordance with the rules of U.S. civil procedure. 11. Final Provisions These legal notices and general terms and conditions may be modified at any time. The applicable version is the one in effect at the time of booking or use of the service.
